Agreeing to these terms
By downloading or using MIMI Babies or MIMI Smart Kids, using our websites, or buying Make it yours, you agree to these terms. If you buy Make it yours for a child, you confirm that you are the child's parent or legal guardian and an adult where you live.
The apps
- We give you a personal, non-commercial, non-transferable licence to install and use the apps.
- Playing happens on the phone and collects no personal data. Make it yours is the only part that sends anything, and only when a parent chooses it.
- The apps are provided as they are, without warranties, as far as the law allows. We do not promise they will be uninterrupted or work on every device.
- You may not copy, resell, reverse-engineer or modify the apps, except as the law allows.
Make it yours
What you get
From two photos you send, we make a 3D character of your child that replaces MIMI in the app, with a 2D portrait and a home-screen icon. It is delivered to a family code and works in MIMI Babies and MIMI Smart Kids: one purchase covers both apps. One phone is included.
Phones
- More phones can be bought in the app, from your own phone for family members or on the new phone. Each extra phone counts in both apps.
- Moving to a new phone is free (Settings, Make it yours, Move to another phone).
- Make it yours is bought and used on Android for now; the iPhone versions do not offer it yet.
Timing
A character is usually ready about 2 days after payment. This is an estimate and can vary with demand and with the photos.
Your promises
- You are the parent or legal guardian of the child, and have the right to send their photos and name, including any consent needed from another parent or guardian.
- What you send is accurate and lawful.
- You use the character for personal, non-commercial purposes only, and never to harm, exploit or misrepresent any child.
Ownership
Your child's character is made for your personal use inside the apps. The apps, the MIMI character and engine, designs, activities and software remain the property of Diviners Group Private Limited. You may not resell, share or extract the character or the apps' assets.
Payments
- Make it yours and extra phones are paid through Google Play, at the price Google Play shows you, including taxes.
- Refunds follow our refund policy and Google Play's rules.
Limits of our liability
As far as the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to what you paid us for the purchase concerned. Nothing here limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of India. Disputes go to the courts of Chennai.
Changes
We may update these terms; the date at the top changes when we do. Using the apps or websites after a change means you accept it.
